These Terms govern your access to Marcel, a business-search product provided by Artek Nexus Inc.

Agreement With Artek Nexus
These Terms are between you and Artek Nexus Inc., the company that provides Marcel. By using Marcel, you accept these Terms.
Use of Marcel
Marcel helps users search, qualify, save, and export business information. You must use Marcel only for lawful, professional purposes and in compliance with applicable laws.
Account and Security
- You are responsible for the accuracy of the information you provide when creating an account.
- You must protect your access credentials and notify us promptly if you suspect unauthorized access.
- We may suspend or limit an account for abuse, non-payment, unauthorized use, or security risk.
Results, Data, and Accuracy
Marcel uses public, commercial, or legitimately obtained sources. Despite quality efforts, information may be incomplete, outdated, mismatched, or unavailable.
You are responsible for validating important information before using it for a business decision, campaign, contract, or external communication.
Credits, Subscriptions, and Payment
- Plans, included credits, top-ups, prices, and limits are shown in the interface or in the applicable quote.
- Subscriptions renew on the selected billing cycle until cancelled, unless stated otherwise.
- You can manage or cancel your subscription from your billing area when that option is available.
- Applicable taxes may be added. Payments are handled by a secure payment provider.
Refunds and Credit Adjustments
Unless required by law or stated differently in writing, paid fees are not refundable once credits, subscriptions, or services have been provided.
When Marcel returns zero usable results or a technical error prevents delivery of a credit-billed service, we may return the affected credits to the account. A search that returns fewer results than requested does not automatically create a partial refund if usable results were delivered.
Custom Services
Custom requests help us evaluate specialized research, export, volume, or processing needs. No Custom work is guaranteed until Artek Nexus accepts a quote or written confirmation.
Prohibited Use
- Using Marcel to break the law, bypass security controls, or harm third parties.
- Trying to copy, bulk-extract, resell as a raw database, or reproduce the service without permission.
- Sending spam, misleading communications, or campaigns that do not comply with applicable laws.
- Trying to discover Marcel’s internal systems, keys, providers, prompts, or proprietary methods.
Outreach and Compliance
If you use results to contact businesses or people, you are responsible for complying with applicable laws, including rules on electronic communications, personal information protection, exclusion lists, and opt-out requests.
Intellectual Property
Marcel, its brand, interface, text, product logic, and software elements belong to Artek Nexus or its licensors. You may use generated results and exports for legitimate internal business needs, but you may not resell Marcel or its exports as a standalone data product without written permission.
Availability and Changes
We may change, suspend, or discontinue parts of Marcel to improve the product, fix issues, manage risk, or meet obligations. We make reasonable efforts to keep the service available, but we do not guarantee continuous or error-free access.
Limitation of Liability
To the extent permitted by law, Artek Nexus is not liable for indirect losses, lost profits, missed opportunities, data loss, or damages arising from your use of Marcel. Nothing in these Terms limits rights that cannot be limited under applicable law.
Governing Law
These Terms are governed by the laws of Quebec and the applicable federal laws of Canada. The competent courts of Quebec will have jurisdiction, subject to mandatory consumer rights that may apply.
